For an Order Reforming a Mortgage
TO: Aaron Pikula and Nichole M. Conroy, and all other persons or parties unknown with respect to real property located at 20017 Nokay Lake Road, Deerwood, MN 56444-8293 and legally described as: The South 600 feet of the East 508 feet of the Southeast Quarter of the Southwest Quarter (SE 1/4 SW 1/4) of Section Twenty (20), Township Forty-six (46) North, Range Twenty-eight (28) West. Except all minerals and mineral rights of record.
Upon receiving and filing the Report of the Examiner of Titles in the above-entitled matter,
IT IS ORDERED, that you, and all persons interested, appear before this Court by Zoom teleconference (instructions attached) on Monday, August 31, 2020, at 10:00 a.m., and then, or as soon thereafter as the matter can be heard:
TO SHOW CAUSE, IF ANY THERE BE, why the Court should not issue an Order reforming the mortgage, Document No. T 175445 in favor of Mortgage Electronic Registration Systems, Inc., as nominee for EquiFirst Corporation, said mortgage recorded February 10, 2005, and assigned to Petitioner by Document No. T 255933, said instrument recorded June 12, 2020, so as to include Nichole M. Conroy as a co-mortgagor along with Aaron Pikula.
Attendance is required only by those who wish to object to the entry of the above described Order.
IT IS FURTHER ORDERED, that this Order to Show Cause be served:
1. At least ten (10) days prior to such hearing upon the above persons residing in this State in the manner provided by law for service of a Summons in a civil action.
2. At least fourteen (14) days prior to such hearing upon any of the named nonresidents by sending a copy of the Order to such non-residents at his post office address, by registered mail or certified mail, return receipt.
3. That service upon any party who cannot be found and upon "all other persons or parties unknown" be had by two weeks publication of the Order to Show Cause and by sending a copy of the Order to Show Cause at least fourteen (14) days prior to the hearing by First Class Mail, to his address as stated on the Certificate of Title, if any address is so stated.
4. Upon a dissolved, withdrawn, or revoked business entity governed by Minn. Stat. Chp 302A, 303, 317A, 322A, 322B, or 323, in the manner provided by Minn. Stat. §5.25.
5. Per Title 28 USC §2410, and Fed R. Civ Pr. Rule 4, the United States Government must be notified at least sixty (60) days prior to the hearing in the manner provided by federal law for the service of the Summons in a civil action.
