Gazelka to offer two insurance bills



State Rep. Paul Gazelka (R-Brainerd) plans to introduce two bills this month that would affect life and auto insurance in the state.

Gazelka said he will introduce a bill in the legislature this month called "No Pay, No Play." The bill would make it illegal for drivers without car insurance to seek legal remuneration in the case of a car accident.

"We'll still cover their medical benefits, but we're not going to allow them to sue for additional benefits and allow them to abuse the system," Gazelka said.

It is illegal in Minnesota to drive a car without basic auto insurance, and Gazelka said he believes this law would cut down on the number of drivers doing so.

"It has the potential of reducing the cost of auto insurance for those legally paying it because the cost of uninsured and underinsured motorists should go down," Gazelka said. The freshman legislator said he expects some opposition to the bill from trial lawyers in the state.

"I've been told that I should expect some opposition because they're the ones that stand the most to lose," Gazelka said.

He also plans to introduce a bill called the "Seniors Life Insurance Protection Act," that would help more seniors qualify for medical assistance.

"Some of these people have purchased life insurance policies over the years and the way it's set up now, they have to spend those down or cash them out...to get aid," Gazelka said. The new law would give them an option of splitting their life insurance benefits with the state in order to qualify for medical aid.

Gazelka said he plans to introduce both pieces of legislation by the end of February.
