NOTICE OF LIEN



FORECLOSURE SALE

YOU ARE NOTIFIED that default has occurred in the conditions of the following described Association liens:

INFORMATION REGARDING LIENS TO BE FORECLOSED:

This is a foreclosure for unpaid annual assessments, including maintenance fees, property taxes, late fees, and accruing interest, as authorized by Minnesota Statutes, Section 317A.161, and the recorded Declaration of Covenants, Conditions and Restrictions ("Declaration") recorded against the below described real estate.

1. Declaration Information:

a. Declaration of Covenants, Conditions and Restrictions dated May 16, 1983 and filed for record in the Office of the Registrar of Titles, Crow Wing County, on May 18, 1983 as Document Number 59692.

b. Said Declaration gives Pelican Cove Owners Association, Inc., a Minnesota non-profit corporation ("Association") a continuing lien against the following described timeshare intervals for unpaid annual assessments, together with interest, costs, and attorneys' fees.

2. The Association has complied with all conditions precedent to foreclosure of the liens as set forth below and as required by statute.

INFORMATION REGARDING PREMISES AND LIENS

3. The owner of record, legal description, tax parcel number, street address, certificate of title number, lien recording information, original lien amount, and current lien amount for each affected parcel pursuant to this Notice are as follows:

a. Owner of Record: Ruby I. Steeke.

(1) Legal Description: Use Period Nineteen (19), Lot One (1) Block One (1), of Pelican Cove, according to the plat thereof on file and of record in the office of the Registrar of Titles, Crow Wing County, Minnesota; except all minerals and mineral rights of record.

(2) Tax Parcel Number 101760010010009.

(3) Street Address: 9375 Breezy Point Drive, Breezy Point, Minnesota 56472.

(4) Certificate of Title Number 60216.

(5) Lien Recording Information: Notice of Lien, dated November 19, 2011 and filed for record on December 21, 2011 as Document Number 214372 in the Office of the Registrar of Titles, County of Crow Wing, State of Minnesota.

(6) The lien amount, as stated on the above-referenced Notice of Lien, was $1,136.21.

(7) The lien amount, as of the date of this Notice, is $1,143.86.

b. Owners of Record: Richard L. Waletzko and Edna W. Waletzko, as joint tenants and not as tenants in common.

(1) Legal Description: Use Period Six (6), Lot Four (4), Block One (1), of Pelican Cove, according to the plat thereof on file in the office of the Registrar of Titles, Crow Wing County, Minnesota; except all minerals and mineral rights.

(2) Tax Parcel Number 101760010040009.

(3) Street Address: 9375 Breezy Point Drive, Breezy Point, Minnesota 56472.

(4) Certificate of Title Number 57923.

(5) Lien Recording Information: The Association has recorded two Notices of Lien concerning this matter. The first is dated November 14, 2008 and was filed for record on November 18, 2008 as Document Number 0198613 in the Office of the Registrar of Titles, County of Crow Wing, State of Minnesota. The second is dated November 19, 2011 and was filed for record on December 21, 2011 as Document Number 214370 in the Office of the Registrar of Titles, County of Crow Wing, State of Minnesota.

(6) The total lien amount, as stated on the second Notice of Lien, was $2,886.09.

(7) The total lien amount, as of the date of this Notice, is $2,905.53.

4. Lien holder for the above-described liens: Pelican Cove Owners Association, Inc., a Minnesota non-profit corporation ("Association").

5. Said Liens have not been assigned.

6. No other action or proceeding at law is now pending to recover the debts secured by these liens, or any part thereof.

7. Said Declaration, in conjunction with Minn. Statutes, Section 317A.161, authorizes said Association to foreclose said liens for unpaid annual assessments, property taxes, late payment fees, and interest by advertisement.

8. Said real property is Registered (Torrens).

INFORMATION REGARDING FORECLOSURE:

9. The Association is not a transaction agent, mortgage servicer, mortgage originator, lender, or broker as defined by Minn. Stat. Section 58.02.

10. The requisites of Minn. Stat. Section 580.02 have been satisfied.

11. Pursuant to the power of sale in the above-referenced Declaration, and pursuant to Minnesota Statutes, Section 317A.161, said liens will be foreclosed, and the premises subject to said liens will be sold by the Sheriff of Crow Wing County, Minnesota, at public auction on February 16, 2012, at 10:00 a.m., at the Sheriff's Main Office, Law Enforcement Center, 304 Laurel Street, Brainerd, Minnesota, 56401.

12. The time allowed by law for redemption by the Owner of Record or its personal representatives or assigns is six (6) months after the date of sale.

THIS COMMUNICATION IS FROM A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.

THE RIGHT TO VERIFICATION OF THE DEBT AND IDENTITY OF THE ORIGINAL CREDITOR WITHIN THE TIME PROVIDED BY LAW IS NOT AFFECTED BY THIS ACTION.
