Litzau to be released back to Pine River
Level three predatory offender Robert Arthur Litzau is moving back to Pine River.
Cass County Sheriff Tom Burch said Litzau, 71, is scheduled to be released from custody on Thursday and has disclosed his plans to live on the 24th Avenue Southwest in rural Pine River.
Burch reports that there will not be a community meeting as the offender’s information and appearance has not changed since Litzau’s last release in January.
Litzau was taken into custody on Aug. 19 when he violated the conditions of his release. Litzau failed to register as a predatory offender. He was housed in the Cass County Jail until he appeared for his violation hearing, at which time, it was decided he would return to the Minnesota Correctional Facility in Lino Lakes.
Burch said deputies will hand-deliver notices of the release door-to-door in the immediate area of the offender’s listed residence and to school facilities and day care facilities to inform the public of Litzau’s release. Litzau will continue to be on intense supervision through the sheriff’s office and the Minnesota Department of Corrections (DOC).
Litzau was convicted April 5, 1999, for felony fourth-degree criminal sexual conduct with a 15-year-old male victim in Crow Wing County. Litzau fondled a juvenile male, whom he knew, and showed the victim pornography and penetration was involved.
The DOC reported in previous community notification meetings that Litzau had numerous allegations against him before 1999 that involved criminal sexual conduct with juvenile males that included penetration from the late 1980 to the early ‘90s. However, Litzau was never charged with the allegations.
Litzau violated the conditions of his release in 2011 by not registering as a Level 3 predatory offender in Cass County. This was Litzau’s second offense in failing to register as a Level 3 predatory offender. Litzau was sentenced to serve two years in prison, minus the time he has already spent in custody. The judge also imposed a 10-year conditional release period, which was triggered by the fact that Litzau is a Level 3 predatory offender.
According to the DOC in February, it was reported that Litzau will be under extensive supervision as a predatory offender by DOC agents until 2023. There will be four agents monitoring Litzau. Litzau also will have to register as a Level 3 predatory offender until 2033, when he will be 90-years-old.
Litzau also has had other criminal charges against him. He was charged with obstructing the legal process with force for an incident that occurred in Pequot Lakes in February of 2011 in which a Pequot Lakes Police officer suffered minor injuries while attempting to arrest Litzau. Litzau was sentenced in Cass County for the felony crimes of violation of predatory offender registration requirements and second-degree burglary of a dwelling for offenses occurring in the Pine River-Backus area between approximately May 5 and May 27, 2010.
Litzau served his prison time for the burglary charges.

Litzau will be living by himself in a trailer home. The property Litzau will be residing on also has another home that is occupied by his friend.
Litzau is described as having blue eyes, gray hair, a medium build. is 5 foot 10 inches tall and is 155 pounds.
